Biography
David Fleissig is a commercial litigator with deep experience in commercial and hedge fund litigation, employment disputes, securities law, art law, and alternative dispute resolution. He also represents clients in regulatory matters, including investigations by the SEC, the DOJ, the New York Attorney General, and the New York District Attorney’s Office.
David’s clients include hedge funds, high-net-worth individuals, art galleries, and other businesses. David’s practice has an international component as well, handling litigation and government investigations in France, the U.K., and Spain, among other jurisdictions.
David finds that working as part of a small firm enables him to focus intently on the needs of individual clients and be creative in his client advocacy. A persuasive litigator and writer, David shapes powerful legal strategies aligned with each client’s business objectives. He began his practice as a litigator at Skadden before joining the firm.
Notable Matters
A significant hedge fund manager hired David after failing to prevail on a summary judgment in a multimillion-dollar contractual dispute that had been pending for several years. Just a few months later, following a three-day bench trial, David secured a verdict in favor of the client that awarded the client seven-figure damages.
David successfully represented the former chief operating officer of a billion-dollar hedge fund who claimed he was underpaid millions of dollars in connection with his separation with the company. Without filing a complaint and not withstanding significant legal hurdles to any claim, David secured a favorable settlement on behalf of the client following a one-day mediation.
David successfully defended a prominent art advisor in connection with a request by international litigant to secure discovery about the advisor’s clients for use in a criminal investigation by the New York District Attorney’s Office relating to New York State sales tax.
A prominent art gallery faced what could have been a lengthy and wide-ranging sales tax investigation by New York Attorney General. After Making a single presentation, David and the firm were able to convince the Attorney General to close the investigation within weeks of the matter commencing.
